Sending a DMCA Takedown Without a Service

So, someone stole your content and you need it down ASAP to avoid losing revenue, but a service like BranditScan (click here for my referral link if you’d like to join my preferred service when finances get a bit better) or Rulta is out of the budget. That is okay! There is a way to do this manually, its just going to be a bit of a hassle. But lets make it as easy as possible and break it on down!

Step-By-Step Takedown Process

Step 1: Screenshot your ass off

Get every bit of evidence you have. Screenshot your stolen content, copy the links to your stolen content, screenshot where you originally posted content, copy the links to where you originally posted the content. Gather every single drop of irrefutable evidence against them you have to help pad your take down request. Consider even saving the offending web page as a PDF with the sites link and the date attached at the bottom for even harder to argue proof. Get as much digital evidence that you can find that someone has infringed upon your rights.

To save a page as a PDF, simply print, print as PDF, in more setting click the box for headers and footers to ensure the date and site link show, then print!

Step 2: Figure out who is hosting the site (not the poster, the host!)

I suggest using this site to do so: Accu 21 Web Hosting. Type the domain into the search bar and enter! Lets run an example together. Lets say this site (https://coomer.su/artists) has stolen your content.<figure>The domain for them is coomer.su, we leave out the https, www, and anything after the final slash.

Hit enter and it will let us know who the host is such as below: This shows us the location, IP, ISP and the hosting provider

Looks like our hosting provider is Iqweb LLC. We need to make sure to have that information written and ready for our final take down notice we will be sending.

Step 3: Figure out who the copyright agent is (AKA who we are sending our notice to)

Some sites will have this information publicly posted. This can often be found by searching through U.S. Copyright Office DMCA Designated Agent Directory.  When that fails, google the hosting providers website. Lets go back to that previous example above. I did both of those things and came up dry. But I went to the site to their contact info and low and behold, they have a legal contact email

Step 4: Put it all together and get your shit back through a take down notice

Now we put everything in digital ink and yell at the thieves. For a DMCA take down notice to be legally binding it must include:

A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or intellectual property right that has been allegedly infringed upon;

  • Identification in sufficient detail of the material being infringed upon;
  • Identification of the material that is claimed to be infringing upon the intellectual property. Include information regarding the location of the infringing material with sufficient detail so that the web host is capable of finding and verifying its existence;
  • Contact information about the notifier including the name of the intellectual property owner, the name and title of the person contacting the web host on the owner’s behalf, the address, telephone number, and, if available, e-mail address;
  • A statement that the notifier has a good faith belief that the material is not authorized by the intellectual property or copyright owner, its agent, or the law;
  • A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the intellectual property or copyright owner.

I threw together a quick sample of what a DMCA notice might look like below

Date:

Attn Web Site Owner: infringing site name

Via Email: email you SENT to
